1. Scope

These Terms of Use govern the use of the mobile application “Windmate” (“App”) and the website www.Windmate.de. By installing and using the App you agree to these terms.

2. Service Description

Windmate provides wind and weather forecasts as well as community features for watersport enthusiasts. We provide the App and its content using state-of-the-art technology but give no guarantee for the accuracy, completeness or constant availability of the provided data.

3. Registration and Account

• Certain features (e.g. community, chat) require registration.
• You must provide accurate and complete information when registering.
• You are responsible for keeping your login credentials secure and for all activities carried out through your account.

4. Rules of Conduct

It is prohibited to:

• publish illegal, offensive, discriminatory or otherwise inappropriate content,
• use the App for spam, advertising or automated data scraping,
• bypass technical measures or compromise the security of the App.

We reserve the right to suspend or delete accounts in case of violations.

5. Rights to User Content

• Content you create yourself (e.g. posts, chat messages) remains your intellectual property.
• You grant us a simple, worldwide, royalty-free licence to display and store this content within the App.

6. Disclaimer of Liability

• You use the App at your own risk.
• We are not liable for damages arising from the use or inability to use the App unless caused intentionally or by gross negligence.
• Wind and weather forecasts are inherently uncertain. Any decisions you make based on these forecasts (e.g. sporting activities) are your own responsibility.

7. Changes to the App

We may modify, add to or discontinue the App and its features at any time, provided this is reasonable for the users.

8. Termination

You may stop using the App at any time by deleting it or deactivating your account. We may suspend or delete accounts if users significantly or repeatedly violate these Terms of Use.

9. Privacy

10. Applicable Law

These terms are governed by the laws of the Federal Republic of Germany. The place of jurisdiction, as far as legally permissible, is the provider’s registered office.
